Reprint of the final edition containing revisions made by the author and a biography, along with the supplementary volume by Thomas Mackay. Nicholls [1781-1865] was a pioneering poor-law reformer and administrator. While Great Britain's Poor Law Commissioner he drafted the Irish Poor-Law Act (1832). One of the first to assert that relief bred a culture of dependency and a resistance to work, he advocated the abolition of relief except as a last resort. In addition to the present study he wrote A History of the Scotch Poor Law (1856) and A History of the Irish Poor Law (1856), both of which are available in reprint editions by The Lawbook Exchange, Ltd. Like his other studies, this one relates the evolution of poor laws since the medieval era to economic, social and political history. Notably sophisticated works, they were held in high regard by Sir Leslie Stephen and F.W. Maitland.

A review of Aristotle's Laws of Logic in light of the (equal and opposite) paradigm of man and woman balance. Author Bio: Christopher Alan Anderson (1950 - ) received the basis of his education from the University of Science and Philosophy, Swannanoa, Waynesboro, Virginia. He resides in the transcendental/romantic tradition, that vein of spiritual creativity of the philosopher and poet. His quest has been to define and express an eternal romantic reality from which a man and a woman could together stand in their difference and create a living universe of procreative love. Mr. Anderson began these writings in 1971. The first writings were published in 1985. On a personal note, when Mr. Anderson was asked to describe the writings and what he felt their message was he responded, "Spiritual procreation. Mankind has yet to distinguish the two sexes on the spiritual level. In this failure lies the root of our problems and why we cannot yet touch the eternal together. The message of man and woman balance brings each of us together in love with our eternal other half right now." Keywords: Man and Woman Balance, Relationships, Procreation, Spirituality, Love, Metaphysics, Eternal, Creation, Sexuality, & Soul.

The Interaction Of Contract Law And Tort And Property Law In Europe

Against the background of the creation of an EU-wide frame of reference for private law relevant to the Common Market, this study, which was requested by the EU Commission, analyses the dovetailing between contract and tort law on the one hand, and between contract and property law on the other. The study examines the legal orders of almost all the Member States of the EU, illustrates the differences between contractual and non-contractual liability and evaluates the different systems of the transfer of property, of movable and immovable securities as well as trust law. The study comes to the conclusion that the intensive considerations on the creation of a model-law in the area of European private law do not allow these thoughts to be limited to contract law. Such a limitation to the scope of the regarding of this area would probably cause more problems than it would solve, or at any rate not do justice to the needs of the Common Market.

Networks

In the last 20 years interest in network phenomena has grown immensely among anthropologists, psychologists, political scientists, economists and lawyers. Empirical observation shows that network arrangements can be found in many branches of business. This is often linked to rapid changes in today's markets and technologies, but it is not the only reason. Legal institutions have been at the centre of private law since the industrial revolution but today contracts and corporations cannot cope with the risks and opportunities posed by networks. Legal practice needs solutions which go beyond the classical traditions of thinking in the dichotomy of contract and corporation. This volume is the outcome of a conference held in Fribourg, Switzerland, which focused on the legal treatment of contractual networks, in particular questions of network expectations, the fragility of network institutions, and the question of how law can minimise network specific risks towards third parties. The contributors, among them many of the world's leading scholars in this field, include Roger Brownsword, Simon Deakin, Gunther Teubner, Hugh Collins and Marc Amstutz. The book will be of interest to scholars of contract, corporate law, and legal theory.

The Swiss Reformed Theologian Emil Brunner was one of the key figures in the early 20th century theological movement of Dialectical Theology. In this monograph David Gilland offers an account of Bruner's earlier theology in relation to one of the central themes of the Protestant Reformation: Law and Gospel. He examines Brunner's early relationship with fellow Swiss Reformed theologian, Karl Barth and provides a detailed reading of a variety of Brunner's essays from the early to mid-1920s, centering on Brunner's efforts to use the law-gospel relationship to establish a basis for Christian theology. After analyzing the influence this has on Brunner's theological method, Gilland examines Brunner's earliest text on Christology, The Mediator (1927). In light of the preceding analysis, the fourth chapter provides a careful reading of Brunner's controversial polemic against Karl Barth, Nature and Grace (1934).The monograph concludes with reflections on Brunner's earlier theological work and his turbulent relationship with Karl Barth.

Private International Law As Component Of The Law Of The Forum

Author : Michael Bogdan
ISBN : 9789004226340
Genre : Law
File Size : 51.13 MB
Format : PDF
Download : 249
Read : 209

In spite of the undoubtedly great and rising importance of the international legislative co-operation regarding private international law, it must be remembered that no successful unification or harmonization of conflict rules has ever taken place on the universal level, and that the conflict rules stemming from international legislative co-operation between a limited number of countries give rise to the same problems as non-harmonized rules, whenever they have to be used in relation to countries not participating in the legislative co-operation in question. This book will therefore focus on the last-mentioned problems and refrain from dealing with the particular issues arising from international legislative co-operation in the field of private international law. One of the principal aims of Michael Bogdan is to demonstrate the relationship between the national rules of private international law and the rest of the legal system of the forum country, in the first place its substantive private law and its law of civil procedure, as well as to illustrate the impact of the forum country’s general ethical and other values on its private international law.
